You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.

Photography Concept reserves the right to:

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

5.1 All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Photography Concept or otherwise used by Photography Concept as permitted by law.
5.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

6.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Photography Concept for death or personal injury as a result of the negligence of Photography Concept or that of its employees or agents.
7.0 Indemnity
You agree to indemnify and hold Photography Concept and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Photography Concept arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
8.0 Severance
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
9.0 Governing law
These Terms and Conditions shall be governed by and construed in accordance with the law of Belgium and you hereby submit to the exclusive jurisdiction of the Belgian courts.
COVID-19 PERSONAL ATTESTATION, CONSENT, AND WAIVER
Due to the ongoing COVID-19 (SARS-CoV-2) pandemic, Photography Concept is taking extra precautions for the care and well being of our employees and contractors, as well as our clients and their loved ones. By introducing enhanced sanitation/disinfection procedures and keeping to recommended guidelines, we believe we can navigate this period, although there will always be an element of risk. You (as listed above in Billing Details) understand the symptoms detailed below and affirm that neither you, your partner, nor anyone in your household, currently have, nor have experienced any of these symptoms within the last 14 days.
You affirm that neither you, your partner, nor anyone in your household, have been diagnosed with COVID-19 within the past 30 days.
You affirm that neither you, your partner, nor anyone in your household, have knowingly been exposed to anyone diagnosed with COVID-19 within the past 30 days. You affirm that neither you, your partner, nor anyone in your household, have traveled outside of the country, or to any national city considered to be a “hot spot” for COVID-19 infections within the past 30 days.
You understand that Photography Concept cannot be held liable for any exposure to the COVID-19 virus caused by misinformation detailed on this form. You also understand that Photography Concept cannot guarantee that neither you, your partner, nor anyone in your household will not become infected with COVID-19.
The symptoms of COVID-19 include but are not limited to:
– Fever or chills
– Cough
– Shortness of breath or difficulty breathing
– Fatigue
– Muscle or body aches
– Headache
– New loss of taste or smell
– Sore throat
– Congestion or runny nose
– Nausea or vomiting
– Diarrhea
By checking the box “I have read and agree to the website terms and conditions” on this webpage, you acknowledge the contagious nature of COVID-19 and you agree to each statement herein and release Photography Concept, and its employees and contractors from any and all liability for the unintentional exposure or harm due to COVID-19.
You voluntarily assume the risk that you, your partner, and anyone in your household, may be exposed to or infected by COVID-19, by attending the photo shoot and that such exposure or infection may result in personal injury, illness, permanent disability, or death.
You understand that the risk of becoming exposed to or infected by COVID-19 during your photo shoot with Photography Concept may result from the actions, omissions, or negligence of yourself and others, including, but not limited to the photographer and other studio employees and contractors, such as assistants, hairstylists, and make-up artists, if those are present.
You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself, your partner or your family, (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that you, your partner or members of your household may experience or incur in connection with you attending the photo shoot with Photography Concept.
You hereby release, covenant not to sue, discharge, and hold harmless Photography Concept, its employees and contractors from the claims, including all liabilities, actions, damages, costs or expenses of any kind arising out of or relating thereto.
You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Photography Concept, its employees, contractors, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any photography related activities.
Photography Concept agrees to abide by these standards and affirms the same.
